Terms of Use

These Terms of Use apply to the Biostacks mobile application for iOS and Android, including any in-app purchases, subscriptions, features, and content available through the app. They do not govern your use of third-party services such as Apple App Store, Google Play, RevenueCat, iCloud, Google Drive, NIH, Open Food Facts, or any AI assistant you choose to use.

The app

Biostacks is a supplement tracking and information tool. It is provided for personal, informational use only. Biostacks is not a medical device, and nothing in the app (including scoring, interaction warnings, reminders, AI-related prompts, or any other output) constitutes medical advice, diagnosis, treatment, prevention, or professional healthcare guidance. Always consult a qualified healthcare professional before making changes to your supplement or medication regimen. Do not use Biostacks for emergencies or as a substitute for professional medical judgment.

License

Biostacks is licensed, not sold, to you. Subject to these terms, Hmujo LLC grants you a personal, nontransferable license to use Biostacks on devices you own or control, as permitted by the Apple App Store or Google Play usage rules. You may not copy, distribute, sublicense, rent, lease, sell, modify, create derivative works from, reverse engineer, decompile, disassemble, or attempt to extract the source code of Biostacks, except to the extent applicable law does not allow that restriction. If you transfer or sell a device with Biostacks installed, you must remove the app from that device first.

Subscription

Biostacks Pro may be available as a monthly or yearly auto-renewing subscription, purchased through the App Store or Google Play. Payment is charged to your Apple or Google account at confirmation of purchase. Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your store account may be charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancellation stops future renewals but does not automatically refund the current billing period unless required by the applicable store policy or law.

Free trial

New subscribers may be offered a free trial period. Trial length, price, and renewal terms are shown before purchase and may vary by platform, region, or offer. Unless cancelled before the trial ends, a free trial converts into a paid subscription. Any unused portion of a free trial may be forfeited upon purchase of a subscription.

Your data

All data you enter into Biostacks is stored on your device. We do not have access to it unless you choose to share it with us. Optional features such as cloud backup, barcode lookup, manual export, and AI sharing may send data to third-party services as described in our Privacy Policy.

Third-party services

Biostacks may interoperate with third-party services such as Apple App Store, Google Play, RevenueCat, iCloud, Google Drive, NIH, Open Food Facts, and AI assistants you choose to use. Those services are governed by their own terms and privacy policies, may not be available in all places, and may change, suspend, or discontinue access at any time. You use third-party services at your own risk and are responsible for any data you export, import, back up, or share with them.

Data accuracy

Supplement interaction, scoring, nutrition, and product data may be sourced from third parties and public datasets, including NIH, USDA FoodData Central, Open Food Facts, DrugBank-derived data, and publicly available academic sources. This data may be incomplete, out of date, or inaccurate. Biostacks may fail to identify relevant interactions, contraindications, allergies, dosage concerns, or other risks. Do not rely on it as a substitute for professional medical guidance.

Acceptable use

You must be at least 16 years old to use Biostacks. You may not use Biostacks for any unlawful purpose or in any way that could harm others, infringe another person’s rights, or violate the terms of any third-party service used with the app.

Termination

Your license to use Biostacks terminates automatically if you violate any of these terms. Upon termination, you must stop using the app and delete all copies from your devices.

Disclaimer of warranties

Biostacks is provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Hmujo LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not guarantee that the app will be error-free, uninterrupted, secure, or that any information it provides is accurate, complete, or current.

Limitation of liability

To the fullest extent permitted by law, Hmujo LLC and its developers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, personal injury, or other damages arising from or related to your use of, or inability to use, the app. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

Apple and Google

Biostacks is licensed, not sold, to you for use on devices you own or control, subject to these terms and the usage rules of the Apple App Store or Google Play. Apple Inc. and Google LLC are not parties to these terms and are not responsible for the app or its content. Hmujo LLC is responsible for providing any maintenance or support for Biostacks, and Apple and Google have no obligation to furnish maintenance or support services for the app.

To the fullest extent permitted by law, Apple and Google have no warranty obligation for Biostacks. Any claims relating to the app, including product liability claims, legal or regulatory compliance claims, consumer protection claims, or intellectual property infringement claims, are the responsibility of Hmujo LLC and not Apple or Google. If you downloaded Biostacks from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce these terms against you as a third-party beneficiary.

You may not use, export, or re-export Biostacks except as authorized by United States law and the laws of the jurisdiction where you obtained the app. You represent that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties, including the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. You also agree not to use Biostacks for any purpose prohibited by United States law. In the event of any conflict between these terms and Apple’s or Google’s applicable usage rules, the applicable store rules will prevail.

U.S. government users

Biostacks and related documentation are “Commercial Items,” as that term is defined at 48 C.F.R. 2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation.” U.S. government end users receive only those rights granted to all other users under these terms.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

Changes

We may update these terms from time to time. Continued use of the app after changes are posted constitutes your acceptance of the revised terms.
